Section 1: Scope & Precedence of Executed Consulting Contracts (MSA / SOW)

These Terms govern public access to the portfolio case studies, architectural documentation, credential records, and informational pages published on kamillek.com, as well as preliminary inquiries sent prior to a formal engagement.

Any paid operations consulting, fractional COO leadership, AI systems architecture, CRM engineering (Salesforce / HubSpot), or advisory engagement is governed by a separate, mutually executed written Master Services Agreement (MSA) and Statement of Work (SOW). In the event of any conflict between these Website Terms and an executed MSA or SOW, the terms of the signed MSA and SOW shall prevail.

Section 2: Informational Disclaimers & Independent Contractor Status

All materials published on kamillek.com, including all 25 case studies, system architecture diagrams, technical specifications, frameworks, and empirical project telemetry, are provided strictly for general informational and professional evaluation purposes:

Section 3: Intellectual Property Ownership & Third-Party Trademarks

All original content, case study narratives, architectural diagrams, the proprietary PPPP Framework (People, Process, Platform, Performance), interface code, and photography published on kamillek.com are the intellectual property of Kamilla Gafurzianova (© 2026 Kamilla Gafurzianova. In client engagements, all pre-existing methodologies, reusable architectural templates, and background know-how remain the sole property of the Consultant unless expressly assigned in a signed Statement of Work.

All third-party company names, product names, logos, and certification marks referenced on this website, including Salesforce, HubSpot, Google Cloud, Project Management Institute (PMI), the United States Olympic & Paralympic Committee (USOPC), USA Fencing, LA28, PlayLA, and Olympic / OLY designations, are the property of their respective owners and are used strictly for factual identification of professional history, completed project roles, and verified credentials.

Section 4: Limited License & Acceptable Use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the pages of this website and to cite public portfolio materials for personal review or internal business evaluation of a potential consulting engagement, provided that clear attribution to Kamilla Gafurzianova and a link to https://kamillek.com are preserved.

When accessing this website, you agree not to:

Exclusion of Indirect & Consequential Damages: In no event shall Kamilla Gafurzianova be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your access to or use of this website.
Aggregate Liability Cap: Total cumulative liability for all claims arising out of or relating to this website or these Terms shall not exceed the greater of: (a) the total consulting fees actually paid by the claimant to the Operator under an executed written contract in the twelve (12) months preceding the event giving rise to liability, or (b) One Hundred U.S. Dollars ($100.00 USD) for general website visitors.
Mandatory Statutory Carve-Outs (California & EU / UK Law): Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law, including liability for fraud, willful injury, or violation of law under California Civil Code § 1668, or liability for death or personal injury caused by negligence under mandatory European Union, EEA, or United Kingdom law.

Section 7: Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kamilla Gafurzianova from and against any third-party claims, liabilities, damages, losses, and reasonable attorneys' fees arising out of your breach of these Terms, your unauthorized commercial reproduction of proprietary site content, or your violation of applicable law.

Section 8: Governing Law (California), Dispute Resolution & European Client Protections

Because I live and operate in California, United States, and serve clients in both the United States and Europe, the following governing law and dispute resolution provisions apply:

30-Day Informal Resolution Period: Before initiating any formal litigation or arbitration, the claiming party agrees to send a written notice describing the dispute to kamillek.com/contact.html#inquiry-form and engage in good-faith negotiations for at least thirty (30) calendar days.
California Governing Law & Los Angeles County Venue: Except as otherwise agreed in an executed MSA/SOW or required by mandatory European consumer law below, these Terms and any dispute arising out of them are governed by the laws of the State of California, United States, without regard to conflict-of-law principles (preserving California Business & Professions Code § 16600). Exclusive jurisdiction and venue shall lie in the state and federal courts located in Los Angeles County, California.
European Union, EEA, United Kingdom & Swiss Clause: For commercial B2B clients located in Europe, the governing law and dispute resolution forum specified in your executed MSA/SOW (or California law if no separate contract exists) shall govern. If you access this website as a statutory consumer residing in the European Union, EEA, United Kingdom, or Switzerland acting outside your trade, business, or profession, nothing in these Terms deprives you of the protection of mandatory statutory consumer laws of your country of habitual residence (including EU Directives 93/13/EEC and 2011/83/EU and the UK Consumer Rights Act 2015) or your right to bring proceedings in the courts of your country of residence.
